Legal Victory for Shahid Kapoor’s ‘O Romeo’ as Mumbai Court Refuses to Stall Release

In a major relief for Bollywood superstar Shahid Kapoor and director Vishal Bhardwaj, a Mumbai civil court has cleared the path for the theatrical release of their upcoming action-thriller, O Romeo. The court dismissed a plea seeking a stay on the film’s release, which had been filed by Sanober Shaikh, the daughter of the late Mumbai figure Hussain Ustara.

The decision, delivered on February 6, 2026, ensures that the high-octane drama remains on track for its scheduled worldwide release on February 13, just in time for the Valentine’s Day weekend.

The Heart of the Dispute
The legal battle began when Sanober Shaikh filed a civil suit against producer Sajid Nadiadwala, director Vishal Bhardwaj, and author Hussain Zaidi. Shaikh alleged that the film was an “unauthorized biopic” of her father, Hussain Ustara, a man known in historical underworld accounts but described by his family as a “protector” and a police informant who fought against the D-Company.

Key allegations from the plaintiff included Misrepresentation: Claims that the film portrays her father as a “gangster” rather than a journalist and police asset. Lack of Consent: The family argued that the makers did not seek permission to use Ustara’s life story or likeness.

Reputational Damage: The suit claimed the “wrongful appropriation” of his life would cause irreparable injury to the family’s social standing.

Shaikh had sought a permanent injunction against the film’s release on all platforms, including theatres and OTT, and even demanded ₹2 crore in compensation.

The Court’s Verdict
After hearing arguments from both sides, the court observed that the plaintiff failed to establish a sufficient case to warrant a stay on the release. The filmmakers maintained throughout the proceedings that O Romeo is a “work of fiction” inspired by a chapter in Hussain Zaidi’s book, Mafia Queens of Mumbai, for which they held valid legal rights.

The court’s refusal to stall the film follows the precedent that artistic freedom should not be easily curtailed unless there is clear, undeniable evidence of defamation that cannot be compensated for later.

Director Vishal Bhardwaj recently clarified at a trailer launch that while the “germ of the idea” came from real-life accounts, the narrative has been heavily fictionalized. “This film is from the book… we’ve added a lot of fictional elements,” Bhardwaj stated, emphasizing that the project is a gritty reimagining of Shakespeare’s Romeo and Juliet set against the backdrop of the 1980s Mumbai underworld.

Industry Reaction
The verdict has been welcomed by the film fraternity as a win for creative expression. For Shahid Kapoor, who plays the titular role, the film represents another “madly different character” in his filmography. With the legal clouds now cleared, the marketing blitz for the film is expected to intensify, with the song “Paan Ki Dukaan” already topping charts.
